The Supreme Court today in a historic judgment upheld the government’s decision to abrogate Article 370, which granted special status to the state of Jammu and Kashmir.

Article 370 Verdict: The Supreme Court today (December 11) gave a historic decision on the issue of Article 370. The Supreme Court has said that the central government’s decision to remove Article 370 from Jammu and Kashmir is correct.

The Supreme Court held that the President’s order was valid, saying, ‘We do not consider it wrong to exercise the power of the President to abrogate Article 370’.

All provisions of the country’s constitution can be applied to Jammu and Kashmir. The court has also said that this can be done under Article 370(1)D.

Elections should be held soon in Jammu and Kashmir Supreme Court:

The Supreme Court has said that elections should be held in Jammu and Kashmir as soon as possible. Instructions have been given to the central government in this regard. The court also said that statehood should be given back to Jammu and Kashmir.

Deletion of Article 370 constitutionally valid:

The Supreme Court has said that the removal of Article 370 from Jammu and Kashmir is constitutionally valid. Thus the Supreme Court has clarified that the decision taken by the Central Government is completely correct.

What did the Chief Justice say about President’s rule in Jammu and Kashmir?

Chief Justice DY Chandrachud said that we have not taken any decision on the President’s rule imposed in the state during that time. President’s rule may be imposed depending on the situation. The President has powers under Article 356. He cannot be challenged. It is a constitutional condition that they should be used properly. Article 356 – Dissolution of state government and imposition of President’s rule. Under President’s rule, the central government can take decisions in place of the state government. Parliament can act in place of State Legislature.

Meanwhile, on August 5, 2019, the central government abrogated Article 370 of the Constitution, which gave special status to the state of Jammu and Kashmir. After the deletion of Article 370, petitions were filed in the Supreme Court objecting to it. A 5-member bench comprising Justice Sanjay Kishan Kaul, Justice Sanjiv Khanna, Justice BR Gavai and Justice Suryakant heard these petitions under the chairmanship of Chief Justice Dhananjay Chandrachud.

 

The government had presented before the court the statistics of how incidents of stone pelting and other violence in Jammu and Kashmir had reduced after the abrogation of Article 370.

After completion of hearing on September 5, the court reserved its decision on the matter. The Supreme Court will give a historic verdict on this today. Therefore, the attention of the entire country including the central government was drawn to this result.

Gulam Nabi Azad on Article 370:

Former Chief Minister of Jammu and Kashmir and President of Democratic Progressive Azad Party Ghulam Nabi Azad has also reacted to this decision of the court. Azad said that the abrogation of Article 370 was a mistake and the political parties of Jammu and Kashmir should also have been asked about it. He further said that this was our last hope from the Supreme Court, the people of Jammu and Kashmir are not happy with this decision.

Meanwhile, National Conference leader and former Chief Minister of Jammu and Kashmir Omar Abdullah said, ‘I am disappointed by this decision, the struggle will continue. It took decades for BJP to reach this point.

They are free to come to their party offices, while some of us are chained at our gates. At Gupkar Road, the media is not allowed to take any comments from us.
