Delivery Boy: “This is a violation of the rights of delivery workers, especially those who are critical to the functioning of this platform.”
A complaint has been filed with Tamil Nadu State Election Commissioner B Kothi Nirmalasamy against e-commerce company Flipkart and Tata Group unit BigBasket.
These companies have promised to deliver goods through ‘delivery staff’ in the state on polling day i.e. April 19, which has been declared a public holiday due to polling.
In a complaint filed before Tamil Nadu State Election Commissioner B Kothi Nirmalasamy on Wednesday, Chennai High Court advocate K Narasimhan said that although the state government has declared April 19 as a holiday, Flipkart and BigBasket are promising to deliver the orders.
Narasimhan said that as per government orders, April 19 has been officially declared a public holiday under Section 25 of the Negotiable Instruments Act 1881 to facilitate the election process.
He said that the Labor Welfare and Skill Development Department of Tamil Nadu has made it mandatory to give paid holiday on April 19 to all employees working in shops, commercial establishments, industrial establishments and IT companies to ensure their participation in the democratic process.

“It has come to our notice that online delivery platforms like Flipkart and Big Basket are promising to provide delivery services on April 19 despite the directive,” the complaint said.
“This is a violation of the rights of delivery staff, especially those who are critical to the functioning of this platform.”
The complainant has called for an inquiry into the e-commerce companies’ claims of guaranteed delivery on polling day. And appropriate steps should be taken to uphold the democratic rights of all workers, the complaint said.
According to information received from Flipkart after the complaint, only eligible employees are being given paid leave for voting. He also said that the relevant guidelines for the polling day have been given by officials from Flipkart Group. Also, many steps have been taken to create public awareness about voting.
