Italy Data Protection Authority Notice to Open AI

The Data Protection Authority of Italy has issued a notice to the Open AI company. ChatGPT, a chatbot made by this company, is wrongly collecting user data. This organization has said that this violates the privacy laws of the country.

Italy’s data protection authority is known as ‘the Garante’. The institute has been focusing on Open AI since March last year. The organization is looking into whether ChatGPT is working according to the data privacy rules set by the European Union.

It was banned in Italy

In March 2023, The Garante alleged that OpenAI’s ChatGPT chatbot was illegally collecting users’ private data. He also warned Open AI to immediately stop collecting data on Italian citizens. Open AI was banned in Italy for a while at this time.

Changed by Open AI

After this, Open AI said that it has made some changes in its platform. Open AI explained that it has changed its data collection policy as told by the Italian regulators. According to this, they have provided the option of deleting their data to the users coming from the European Union. Also, the company had created a tool to check the age of new users. Open AI also published a help article on what user data we collect, why we collect it, how we collect it and how to delete it.

Notice sent again

After this, in April, Open AI was allowed again in Italy. But now again it has come to light that Open AI has violated one or more rules. So now the regulatory body has sent a notice to Open AI and Microsoft. They have been given 30 days to respond to this notice.

How much will be the penalty?

The European Union’s General Data Protection Regulation (GDPR) was implemented in 2018. According to this, if a company violates the given norms, it may have to pay a fine of four times the global turnover of the company. Now it will be interesting to see if this action takes place on Open AI.
