The Bharatiya Janata Party government led by Chief Minister Pushkar Singh Dhami in Uttarakhand today (January 6) tabled a bill related to the Uniform Civil Code in a special assembly session. The draft in this regard was handed over to CM Pushkar Singh Dhami by the UCC committee a few days ago. Meanwhile, today we are going to know what changes will happen after the implementation of UCC in Uttarakhand, as well as what will be the impact on the lives of common citizens.
What will happen after implementation of UCC in Uttarakhand?
• The age limit for marriage for girls of all religions will be 18 years.
• Both men and women shall have equal rights of divorce.
• It will be mandatory to declare live in relationship.
• 6 months punishment if live in registration is not done
• Children born out of live-in have equal rights in property
• There will be no condition for women to marry a second time.
• Scheduled Tribes will be outside the periphery
• Prohibition of polygamy, second marriage is not allowed if husband or wife is alive.
• Registration of marriage is mandatory, otherwise facilities will not be available.
• Equal rights for daughters as heirs
What will change if the UCC applies?
• There will be one law for marriage and divorce in every religion
• What is law for Hindus is going to be for other religions also.
• There cannot be more than one marriage without divorce.
• Muslims cannot have four marriages.
What won’t change after the UCC comes into effect?
• There will be no change in religious beliefs.
• Religious customs will remain the same
• Rituals will be performed by Pandit and Maulvi in the wedding ceremony.
• There will be no effect on food, worship, clothes etc.
During the assembly elections in 2022, one of the major promises made by the BJP to the people was to enact a law on UCC and implement it in the state. After a second consecutive victory in the state of Uttarakhand, which came into being in 2000, the BJP approved the formation of an expert committee to draft the UCC in March 2022 in the first cabinet meeting immediately after the formation of the government.
After the enactment of the Act, Uttarakhand will be the first state in the country to implement the UCC after independence. UCC has been in force in Goa since the time of Portuguese rule. Under the UCC, the same laws regarding marriage, divorce, alimony, land, property, and inheritance will apply to all citizens of the state, regardless of their religion.
