Those who damage public property will not be punished anymore. The Law Commission has made some recommendations to the Central Government for the settlement of such citizens. Now, the Law Commission has recommended that the accused should be granted bail only after depositing the compensation amount for the damage caused to public property.
Also, the Commission has also suggested amendments in the Prevention of Damage to Public Property Act.
The committee headed by Justice Ritu Raj Awasthi, Chairman of the Commission, has given these recommendations in its 284th report. The Commission in its report said that fear of conviction and punishment is not sufficient in cases involving damage to public property under the PDPP Act.
The Commission said that the terms and conditions for granting bail to those who cause damage to public property should be stricter. The accused should not be granted bail unless he deposits an amount equal to the estimated value of the public property. In 2015, the central government had presented a proposal to amend the PDPP Act.
The Ministry of Home Affairs released the draft Prevention of Damage to Public Property Act (Amendment) Bill, 2015 and invited objections and suggestions. But the proposal to amend the original law was not accepted.
The commission has said in its report that incidents of damage to public property are unfortunately occurring in large numbers in our country and will continue to happen. Ignoring this matter will not work.
The Commission further said that it is the moral duty of every citizen to protect public property. It is also in the interest of citizens. Regardless of the reason, no one can be allowed to damage public property. It is easy to destroy such public assets, but not easy to build them.
Stating that public property is national property, the commission also said that every citizen has a share in it. In this report sent by the commission to the government, it has been said that cases of damage to public property should be taken seriously and the culprits should be punished.
